PUBLIC OFFER

for the provision of services for granting access to the electronic magazine “Aksiya market” to individuals via the Website and the Mobile Application

This document is a public offer – a proposal of the Limited Liability Company “Aksiya market” (hereinafter – the Service Provider) to conclude an agreement for the provision of services for granting access to the electronic magazine “Aksiya market” (hereinafter – the Offer).

TERMS AND DEFINITIONS

For the purposes of this Public Offer, the following terms and definitions are used:

Service Provider – LLC “Aksiya market”, which provides the Services in accordance with this Offer.

User / Client – an individual who has completed Registration and has accepted this Offer.

Website – the information system of the Service Provider located at promogo.uz.

Mobile Application – the Service Provider’s specialized software called “Aksiya market”, intended to be installed on the User’s mobile device and used to access the Services.

System – the combination of the Service Provider’s Website and Mobile Application.

Service – granting the User access to the electronic magazine “Aksiya market” for a period of 1 (One) month from the date of Acceptance of the Offer and receipt by the Service Provider of 100% prepayment.

Personal Account (User Account) – a section of the System to which the User gains access after Registration and Authentication, allowing the User to use the Services.

Magazine – the electronic version of the “Aksiya market” publication, access to which is provided as part of the Service.

Registration – the actions of the User to create a Personal Account in the System by providing a mobile phone number and completing biometric identification (Face ID).

Authentication – verification of the User by the System to determine the right to access the Personal Account using Login, Password, Face ID or another method established by the Service Provider.

Face ID – biometric identification of the User using a facial recognition scanner.

Login – the User’s mobile phone number used to access the Personal Account.

Password – a secret sequence of characters set by the User to access the Personal Account.

Compromise – loss of trust in the reliability of the Login, Password or other Authentication data.

Acceptance – the User’s full and unconditional acceptance of the terms of this Public Offer.

GENERAL PROVISIONS

This Agreement defines the terms and procedure for the Service Provider to provide the Service to the User via the System.

The Agreement between the Service Provider and the User is concluded by Acceptance of this Offer in accordance with Articles 358, 360, 367 and 370 of the Civil Code of the Republic of Uzbekistan.

The Service Provider has the right to amend the Agreement unilaterally; amendments become binding from the date the new version is published on the Website.

The User may not transfer rights, obligations or access to the Personal Account to third parties.

The accepted Public Offer is equivalent to a written agreement and has equal legal force.

The User independently provides, at their own expense, all technical and communication resources required to access the Internet and the System.

SUBJECT OF THE AGREEMENT

The Service Provider undertakes to provide the Service, and the User undertakes to accept and pay for it.

The Service is provided for 1 (One) calendar month from the moment all conditions specified in clause 4.2 are fulfilled.

Access to a new issue of the Magazine or extension of access requires repeated Acceptance of the Offer and new 100% prepayment.

Payment for the Service is made on the basis of 100% prepayment in accordance with the tariffs in force on the date of Acceptance.

USER REGISTRATION AND ACCEPTANCE OF THE PUBLIC OFFER

Access to the System is provided via the Website or the Mobile Application.

To accept the Offer and receive the Service, the User must install the Application or access the Website, complete Registration, review and accept the Offer, grant consent for processing all personal data, and make 100% prepayment.

The Offer is considered accepted upon receipt of full prepayment by the Service Provider.

IDENTIFICATION AND AUTHENTICATION PROCEDURE

Primary Identification is performed during Registration by linking the phone number and completing Face ID.

Authentication for access to the Personal Account is carried out using Login and Password or Face ID.

MAIN CONDITIONS FOR SERVICE PROVISION AND THE SERVICE PROVIDER’S RIGHT TO RESTRICT ACCESS

Services are provided subject to successful Registration and Authentication, full Acceptance, payment, absence of Compromise and non-transfer of access.

The Service Provider may refuse or restrict access in case of violation of the Agreement, transfer of access to third parties, suspicion of misuse or technical reasons.

The Service Provider may block access at any time without explanation; paid funds are non-refundable. The User agrees not to make claims.

PROHIBITED USES

The User may not modify the System, use it for commercial purposes, copy, decompile or attempt to obtain source code without written consent.

Transfer of access to the Personal Account or Magazine to third parties is strictly prohibited.

Violations entail liability under the legislation of the Republic of Uzbekistan.

RIGHTS AND OBLIGATIONS OF THE PARTIES

The Service Provider undertakes: to properly provide the Service and ensure personal data protection measures.

The User undertakes: to pay in full, comply with the Agreement, ensure device security, keep Login and Password confidential, provide accurate data and notify of Compromise.

The Service Provider has the right: to refuse or restrict Services, process personal data within granted consent, suspend access for technical or security reasons.

The User has the right: to use the Service during the paid period and submit claims within 10 calendar days.

LIABILITY OF THE PARTIES AND DISPUTE RESOLUTION

The Parties are liable in accordance with the legislation of the Republic of Uzbekistan.

The User is responsible for all actions in the Personal Account, including actions of third parties.

The Service Provider is not liable for technical incompatibilities of the User’s devices.

Disputes are resolved through negotiations, and if unresolved, through court proceedings.

TERM OF THE PUBLIC OFFER AND THE AGREEMENT

This Public Offer enters into force from the date of approval by the Service Provider.

The Agreement is valid from the date of Acceptance for the paid period of 1 month or until termination.

Continued use of the System confirms Acceptance of the current version of the Offer.

TERMINATION OF THE AGREEMENT

The Agreement may be terminated by the Service Provider unilaterally or by written request of the User.

The User is notified of termination via push notification, SMS, email or Website notice.

Paid funds are non-refundable.
